Energy Profits Levy (EPL) was a temporary windfall tax imposed by the United Kingdom on the extraordinary profits of oil and gas companies operating on the United Kingdom Continental Shelf (UKCS). Introduced in 2022 in response to exceptionally high energy prices following the global energy market disruptions associated with the COVID-19 recovery and the Russian invasion of Ukraine, the levy sought to raise additional government revenue from producers benefiting from unusually high commodity prices.

The Energy Profits Levy was introduced by the Energy (Oil and Gas) Profits Levy Act 2022 and applied in addition to existing taxes on oil and gas production. The levy formed part of the United Kingdom's broader fiscal response to rising household energy costs, with revenues helping finance government support measures for households and businesses affected by increased energy prices.

Although commonly described as a windfall tax, the Energy Profits Levy was designed with significant investment incentives, allowing qualifying expenditure on new oil and gas projects to reduce the effective tax burden under specified conditions.

History
During 2021 and 2022, global oil and natural gas prices increased sharply because of recovering post-pandemic demand, supply chain disruptions, and geopolitical tensions, particularly following the Russian invasion of Ukraine.

In May 2022, the United Kingdom Government announced the Energy Profits Levy as part of a package of measures intended to provide financial assistance to households facing higher energy bills.

The levy was subsequently amended several times, including increases in the tax rate and extensions to its duration, before being scheduled to remain in force until the end of the decade unless market conditions changed significantly.

Objectives
The principal objectives of the Energy Profits Levy were to:

* tax extraordinary profits earned by oil and gas producers;
* increase government revenue;
* finance energy cost support measures;
* maintain investment in domestic energy production;
* strengthen energy security;
* support fiscal sustainability.

Tax structure
The levy applied to profits generated from oil and gas extraction activities on the United Kingdom Continental Shelf.

It operated in addition to existing taxes on upstream petroleum production and included investment allowances that reduced taxable profits for qualifying capital expenditure on new projects.

The effective tax burden therefore depended upon both profitability and eligible investment activity.

Relationship with windfall tax
The Energy Profits Levy is an example of a Windfall tax.

Unlike some historical windfall taxes, however, the levy incorporated investment incentives intended to encourage continued capital expenditure in domestic oil and gas production.

Relationship with fiscal policy
The levy formed part of the United Kingdom's Fiscal policy by increasing government revenue during a period of exceptional energy prices while financing temporary measures to reduce the economic impact of higher household energy costs.

Relationship with the petroleum industry
The levy applied specifically to the upstream Petroleum industry, affecting companies engaged in the exploration and production of crude oil and natural gas from the United Kingdom Continental Shelf.

Its design sought to balance revenue generation with continued investment in domestic energy production.

Relationship with energy policy
The Energy Profits Levy formed part of broader United Kingdom Energy policy by addressing the fiscal consequences of exceptional energy market conditions while attempting to preserve investment and domestic production capacity.

Relationship with Brent crude
High prices for Brent crude and natural gas contributed significantly to the extraordinary profits that led to the introduction of the Energy Profits Levy.

Movements in international energy prices therefore had an important influence on the revenue generated by the levy.

Applications
The Energy Profits Levy applied to:

* oil producers;
* natural gas producers;
* upstream petroleum companies;
* United Kingdom Continental Shelf operations.

It affected corporate taxation, investment decisions, and government revenue within the United Kingdom energy sector.

Advantages
Supporters argued that the levy enabled the government to capture a portion of extraordinary energy-sector profits while financing assistance for households and businesses affected by rising energy prices. The inclusion of investment allowances was also intended to reduce the potential impact on long-term domestic energy investment.

Limitations
Critics argued that the levy increased tax uncertainty, reduced investment incentives, and could discourage future exploration and production on the United Kingdom Continental Shelf. Others questioned whether temporary windfall taxes should be used as a recurring fiscal policy instrument.

Importance
The Energy Profits Levy represents one of the most significant examples of windfall taxation implemented by the United Kingdom during the 2020s. It illustrates how governments may respond to extraordinary commodity price increases by combining fiscal measures with targeted investment incentives while seeking to balance public revenue, energy security, and private-sector investment.
