The Pension Fund Regulatory and Development Authority (PFRDA) is a statutory regulatory body of the Government of India responsible for promoting, developing and regulating pension funds and protecting the interests of subscribers to pension schemes within its jurisdiction. Established initially as an interim authority in 2003, it became a statutory body under the Pension Fund Regulatory and Development Authority Act, 2013, which came into effect on 1 February 2014.

PFRDA regulates the National Pension System (NPS), administers and regulates the Atal Pension Yojana (APY), and oversees pension-sector intermediaries and activities covered by the applicable legislation. Its mandate includes strengthening old-age income security, promoting an organised pension system and safeguarding subscribers' interests.

History

Background

In 1999, the Government of India launched the Old Age Social and Income Security (OASIS) project to examine ways of improving retirement savings and old-age income security. The initiative contributed to the development of a defined-contribution pension system for government employees, replacing the earlier defined-benefit arrangement for new entrants in the covered services.

The interim PFRDA was established on 23 August 2003 to promote and regulate the emerging pension system. The National Pension System was introduced for new Central Government employees, excluding the Armed Forces, from 1 January 2004. Its coverage was subsequently extended to citizens of India on a voluntary basis from 1 May 2009.

Statutory status

Parliament enacted the Pension Fund Regulatory and Development Authority Act, 2013, to provide a statutory framework for pension-sector regulation. The Act received presidential assent on 18 September 2013 and came into effect on 1 February 2014, establishing PFRDA as a statutory authority under section 3 of the Act.

Objectives and functions

Section 14 of the PFRDA Act, 2013, establishes the Authority's principal duty to regulate, promote and ensure the orderly growth of the NPS and other pension schemes covered by the Act, while protecting subscribers' interests.

Its functions include:

  • Regulating pension schemes covered by the Act.
  • Approving pension schemes and their terms and conditions.
  • Establishing investment guidelines and norms for managing pension-fund assets.
  • Registering and regulating pension-sector intermediaries.
  • Protecting subscribers' interests and overseeing the safety and administration of contributions.
  • Establishing mechanisms for the redressal of subscriber grievances.
  • Adjudicating disputes between intermediaries and between intermediaries and subscribers, within its statutory jurisdiction.
  • Conducting inspections, inquiries, investigations and audits of regulated intermediaries.
  • Promoting pension awareness, financial education and research.
  • Standardising the disclosure of pension-fund performance and benchmarks.

National Pension System

The National Pension System is a defined-contribution retirement savings system regulated by PFRDA. It enables eligible subscribers to accumulate retirement savings through contributions invested in accordance with the scheme's rules and applicable investment guidelines.

PFRDA regulates the framework within which pension funds and other registered intermediaries operate. It establishes requirements relating to investment management, subscriber services, disclosure, operational standards and withdrawals.

The NPS is available to eligible individuals and employees across various sectors, subject to the rules governing the relevant subscriber category and scheme.

Atal Pension Yojana

The Atal Pension Yojana is a government-backed pension scheme aimed principally at workers in the unorganised sector. It provides for a defined pension benefit based on the subscriber's contribution and the scheme's eligibility conditions.

PFRDA administers and regulates APY under the applicable government notification and regulatory framework. Banks and other authorised service providers support enrolment, contributions and subscriber servicing.

Regulatory framework

PFRDA operates primarily under the Pension Fund Regulatory and Development Authority Act, 2013, together with the rules, regulations and government notifications issued under the applicable legal framework.

The Authority regulates pension funds and intermediaries involved in the administration and operation of covered pension schemes. These intermediaries include:

  • Pension funds.
  • Points of Presence (PoPs).
  • Central Recordkeeping Agencies (CRAs).
  • Trustee banks.
  • Custodians of securities.
  • Annuity Service Providers (ASPs).
  • Other entities registered or recognised under the applicable regulations.

The responsibilities of each intermediary are defined by the relevant regulations and registration conditions.

Organisation and governance

Under section 4 of the PFRDA Act, 2013, the Authority consists of a Chairperson and three whole-time members. The Act provides for their appointment and establishes the Authority's governance framework.

PFRDA operates through functional divisions responsible for regulatory supervision, pension-fund management, government-sector pension arrangements, subscriber protection, policy development and the promotion of pension coverage.

The Authority's head office is located at the World Trade Centre, Nauroji Nagar, New Delhi, India.

Subscriber protection

Subscriber protection is a central component of PFRDA's mandate. The Authority establishes requirements for regulated intermediaries and pension schemes, oversees compliance and provides mechanisms for addressing grievances.

Its statutory powers include calling for information, inspecting records, conducting investigations and taking specified protective measures where legally justified. These powers are intended to support regulatory compliance and protect subscribers against misconduct or improper administration of pension assets.

PFRDA's regulatory oversight does not eliminate investment risk in defined-contribution pension schemes. The value of retirement savings may fluctuate according to the performance of the underlying investments and the applicable scheme rules.

Relationship with other financial regulators

PFRDA forms part of India's multi-regulator financial system.

Regulator Principal area of responsibility
Pension Fund Regulatory and Development Authority Pension funds, the National Pension System and pension schemes within its statutory jurisdiction
Securities and Exchange Board of India Securities markets, securities-market intermediaries and investment products under its jurisdiction
Insurance Regulatory and Development Authority of India Insurance industry and insurance-sector intermediaries
Reserve Bank of India Banking system, monetary policy and specified financial institutions

The respective authorities exercise powers under their own legislation. Coordination may be necessary where pension investments involve securities, banking services or insurance products.
